TOWN OF LOCKPORT
ZONING BOARD of APPEALS
January 23, 2007

The Town of Lockport Zoning Board of Appeals meeting was called to order on January 23,2007 at 7:30 pm by Chairman Siejak, who then led the Pledge of Allegiance. Chairman Siejak then announced due to the legal action of 1-11-07 all Public Hearings are adjourned until further notice.

Chairman Siejak stated that all members should have received the minutes from the November 28,2006; December 27,2006; and January 11,2007 meetings.

5780 Ridge Road - SBL #80.00-3-13.21- Vincent Muffoletto II - Chairman Siejak stated Mr. Muffoletto had asked to have his action tabled until next month.

5859 & 5863 South Transit Road & 6210 & 6216 Hamm Road - SBL #138.05-3-1,138.05-3-2,138.05-3-3 & 138.05-3-4 - McDonald's USA, LLC- Chairman Siejak stated that Mr. Hopkins representing McDonald's had contacted Sr. Building Inspector Nenni to ask to have this matter be held up with no Public Hearing to commence until February, and to be removed from the agenda.



Meadowbrook Estates Phase III -12 Lot Subdivision - requesting area variances on 12 subdivision lots for setback consideration. Attorney Seaman stated he will recuse himself from any participation in this matter because of a conflict of interest. Mr. Douglas will be acting as council to the Board. Chairman Siejak stated the Public Hearing is open and will remain open until further notice.

Mike Metzer with Metzer Engineering and Paul Case presenting. Mr. Metzer stated this project is on Old Beattie Road, north of Bartz Road, was approved in
the 90's with a 65 lot subdivision, which was compliant at that time, and is being done in Phases. Mr. Metzer stated Phase I and Phase II are complete. Mr. Metzer stated the light green lots on the map represent Phases I & II, the dark green are Phase III and the white are for future development. Mr. Metzer stated the development was totally compliant, but since then the zoning laws have changed
and now they need variances to complete Phase III. Mr. Metzer stated previously the front setback was 45', rear was 35' and side was 10' with 20' composite. The
current code calls for front and back 50' and side setback 10' with 30' composite.

Mr. Metzer stated Barden has many homes to choose from but they are having a hard time getting the building to fit in the envelope that is now left. Mr. Metzer stated he had hoped their project would be grandfathered, but no clause was put in the new code. Mr. Metzer stated he is not trying to cram anything onto the lot, he would just like to have this Phase consistent with the previous two Phases, to match.

Member Haseley asked if this will be the last Phase and Mr. Metzer replied no, the white areas on the map are the future development. Member Haseley asked if the future lots will meet the new code and Mr. Metzer replied no, but they only want variances for these 12 lots at this time.

Chairman Siejak asked how many homes have been built and Mr. Metzer replied 30.

Chairman Siejak asked if there was any Public Comment regarding the Meadowbrook Estates Subdivision. Hearing no comment Chairman Siejak stated the Public Hearing will remain open and the next meeting will be February 27,
2007 at 7:30 pm.

MOTION made by Member Dahlquist, seconded by Member Lederhaus to adjourn at 7:45 pm. 4 Ayes, 0 Nays, Carried.
