The April 24, 2007 Zoning Board ofAppeals meeting was called to order at 7:30 pm by Chairman Siejak who then led the Pledge ofAllegiance Chairman Siejak noted all Board
members are present.

Chairman Siejak noted the March 22 2007 minutes have not been received yet.

CASE 1 5859& 5863 South Transit Road and 6210& 6216 Hamm Road SBL#138.05-3-1,138.05-3-2,138.05-3-3,138.05-3-4 - McDonald's USA LLC -
Returning applicant seeking area variances in order to construct a 4654 sq.ft. restaurant and associated site improvements. Chairman Siejak stated a letter has been received from McDonald's requesting a continuance.

MOTION made by Member Lederhaus, seconded by Member Dahlquist to grant McDonald's a continuance on the Public Hearing for 5859 5863 South Transit Road and 6210& 6216 Hamm Road until May 15th. 5 Ayes, 0 Nays, Carried.

Chairman Siejak noted there will be a Public Hearing for McDonald's at the May 15th Planning Board meeting for a special use permit.

CASE 2 6470 Rapids Road SBL#152.01-3-51 - John Sgroi, owner - Applicant seeking area variance to construct a family room addition and a detached garage. Mr Sgroi presenting Chairman Siejak opened the Public Hearing Mr Sgroi stated he has 4 children 2 of which are now driving additional cars. Mr Sgroi stated he will be using part of the current attached 2.5 car garage for part of the
family room and will lose his storage space. Mr Sgroi stated he has a classic car and another car that he stores in the garage. Mr Sgroi stated the entrance to the
garage is from Emily Lane not from Rapids Road.

Member Lederhaus questioned the necessity for the variances and asked whether the garage could be put along the side ofthe addition instead ofin front. Mr Sgroi stated he would lose his yard as this is a corner lot and he has a pool in the back yard and he is trying to keep the current driveway that has a turn around, and
also he would lose the windows in the family room if he put the garage alongside the family room. He indicated that there is a 6' stockade fence at the property line

and the garage would be approximately 17'9' inside the fence. Mr Sgroi also stated he would only have a patch of grass around the pool that would be usable. Member Haseley stated he feels this is a substantial change to the neighborhood that doesn't meet the criteria for a variance and also feels that the family room and garage could both be moved back.

Member Loiars questioned why there is 5' between the garage and the family room. Mr Sgroi stated he didn't want it to be an attached garage as it would be much more expensive to build with, the required foundations etc.

Member Loiars asked if the neighbors know. Mr Sgroi stated yes, and the ones he spoke with didn't object and one of the neighbors had built a family room on his home several years ago that was close to the lot line and Mr Sgroi
didn't object to it. Member Loiars stated he felt the family room should be moved back. Mr Sgroi stated if he moved the family room back it would be about 5' from the
pool and the current patio goes to the edge of his home.

Mr Sgroi asked if the Board would be more comfortable if the garage was a little smaller instead of 24'x 24'. Member Haseley stated he would like to see it about half of the size and only stick out a few feet in front of the home or put the garage in front of the family room. Mr Sgroi stated he would have to redesign the rooflines and everything to do that. Member Lederhaus stated he feels too much of the building is in front of the home and that it changes the character of the neighborhood. Member Haseley stated the family room is fine it is the garage
that makes it too much. Mr Sgroi stated he couldn't do the family room without the garage as he won't have storage for the two cars. Member Loiars asked if the
garage could be cut down to 14'. Mr Sgroi didn't feel
14' was large enough but maybe 20'. Chairman Siejak stated the Board has concerns about putting too much building on a lot. Member Haseley stated past practice has been to allow about 6' to 8' in front of the building and that would make it about in line with Mr Sgroi's neighbor to the south and that 50' is required where Mr Sgroi is asking for 17', which is a substantial variance.

Mr Sgroi asked that his request be tabled until the May meeting to give him time to weigh his options.

MOTION made by Member Haseley seconded by Member Loiars to table the area variance to construct a family room and detached garage until the May 22nd Zoning Board ofAppeals meeting and to keep the Public Hearing open.
5 Ayes,0 Nays, Carried.

MOTION made by Member Dahlquist seconded by Member Hasley to adjourn the meeting at 7: 55 pm. 5 Ayes,0 Nays, Carried.
