ZONING BOARD OF APPEALS

The June 24, 2008 Zoning Board of Appeals meeting was called to order by Chairman Lederhaus who then led the Pledge of Allegiance.
MOTION made by Member Jablonski, seconded by Member Dahlquist to accept the May 27, 2008 minutes. 3 Ayes, 0 Nay, Carried.
CASE #1 6586 Harvest Ridge Way – SBL #138.04-2-29 – Janine & Donald Dougher – Requesting an area variance to construct an additional garage and storage space to existing garage. It will be 10’ from the East and 14’ from the West property lines. Required combined setback is 30’. Mr. Dougher presenting. Mr. Dougher stated he would like the additional garage space to store a trailer and truck, which will allow more room in the existing garage to put a vehicle in.
Chairman Lederhaus opened the Public Hearing and asked if there are any sheds on the property. Mr. Dougher stated no, he doesn’t care for sheds but by extending the existing garage he is allowing storage space for his tools.
Member Dahlquist asked if there will be living space above. Mr. Dougher stated, no it won’t be lofted and there won’t be a man door or any windows, just the front doors. Mr. Dougher stated the 2nd floor will have 3 windows, but limited headspace and will just be for storage. Mr. Dougher stated the siding and roof will match the existing house.
Chairman Lederhaus asked Mr. Dougher if he had any letters from the neighbors. Mr. Dougher stated no, but no one had objected.
Chairman Lederhaus asked if there will be gutters on the garage. Mr. Dougher stated yes, everything as it is with the house, including underground gutters.
Chairman Lederhaus asked if there is a fence and Mr. Dougher stated no.
Town Building Inspector Belson noted the utilities will need to be moved to the outside of the new garage. Mr. Dougher stated he is aware it is a NYSEG requirement.

Member Dahlquist asked if there are any easements on the property and Mr. Dougher stated there is a 10’ drainage easement in the back.
Town Building Inspector Belson stated there will have to be fireboard between the house and the garage. Mr. Dougher stated most of it is rock now and he will be sure there is double rock.
Chairman Lederhaus asked for public comment. Hearing no comment, Chairman Lederhaus closed the Public Hearing.
MOTION made by Member Jablonski, seconded by Member Dahlquist to approve the requested area variance under Town Law 267b for Janine & Donald Dougher at 6586 Harvest Ridge Way to waive the 30’ total requirement based on the following findings:
1. the requested variance will not produce an undesirable change in the character of the neighborhood;
2. the benefit sought by the applicant cannot be achieved by any other feasible method;
3. the requested area variance is not substantial;
4. the proposed variance will not have an adverse effect on the environmental conditions in the neighborhood; and
5. the difficulty was not self-created.
3 Ayes, 0 Nays, Carried.
MOTION made by Member Dahlquist, seconded by Member Jablonski to keep Walgreen’s Public Hearing open until the July 22, 2008 meeting. 3 Ayes, 0 Nays, Carried.
MOTION made by Member Dahlquist, seconded by Member Jablonski to adjourn. 3 Ayes, 0 Nays, Carried.
