PLANNING BOARD MEETING MINUTES
June 17, 2008

The June 17, 2008 Planning Board meeting was called to order at 7:30 pm by Chairman Forsey who then led the Pledge of Allegiance.

MOTION made by Member Thorman, seconded by Member Kinyon to accept the corrected May 20, 2008 Planning Board minutes. 7 Ayes, 0 Nays, Carried.

CASE #1 7074 Longview Drive – 124.01-3-30 Sparks Custom Homes & William Schutt Association – Concept Plan – 60+ Acres. Proposed Subdivision of 40 Single Family Homes & 31 Patio Single Homes. Residential 1 (R1) Zoning Classification. Peter Johnston, Engineer for William Schutt Association presenting with David Sparks of Sparks Custom Homes. Mr. Johnston stated the project is on almost 61 acres of which 17 or 18 acres are in the DEC Wetland. Mr. Johnston stated that west of NYSEG they are requesting to put in 40 single lots that meet all the required setbacks, with water, sewer and storm drainage all available. Mr. Johnston stated the storm drainage will drain into the retention pond and then to the ditch. On the east side of NYSEG is where they will put the cluster development on 19.8 acres, and again avoid the wetlands. Mr. Johnston stated they had laid the project out as standard conforming lots and then put them in a cluster development with sewer and water lines coming from the main lines. Mr. Johnston stated a cluster development is a smaller footprint that allows for common open space and all the patio homes are in the interior with a 65’ buffer line in back of the lots as well as 20’ more to the pavement. Mr. Johnston stated this project gives a different product for people who don’t usually use the services of the Town as they generally have fewer children, less traffic, and a mixed use development appeals to a variety of people. Mr. Johnston stated an environmental study will be done, the DEC wetlands will be avoided, the property will be surveyed in a few days and they have asked for NYSEG approval, then they will meet with the DEC.

Member Langdon asked if another exit on Lincoln Avenue would be possible. Mr. Johnston stated they looked at the possibility of another exit where there is a

50’ wide access, which doesn’t comply with the 66’ required, where there is a driveway that would have to be relocated. They also own another strip leading to Lincoln Extension, various easements and utilities make that access not feasible. Mr. Johnston noted that other developments in the area, such as Old English Road, only have one access.

Member Conrad questioned whether the application is just for patio homes currently and if the property will be fully taxed. Mr. Johnston stated no they are applying for both the cluster and patio, and it is their intention to be fully taxed.

Member Kinyon asked if this will be a Homeowner’s Association and Mr. Johnston stated he didn’t know. Mr. Sparks stated there will be a Homeowner’s Association for the patio homes, but not for the traditional single family portion.

Member Thorman asked where the green space is. Mr. Johnston pointed it out on the site plan and stated it equals 10.9 acres out of 19 acres, which is equal to 51%.

Member Balcerzak questioned if there is a turn around, since it is a public road. Mr. Johnston stated yes, a standard Town turn around with driveway access.

Member Wingard asked if the road would be lined up with the right of way across the road and Mr. Johnston stated it is not a right of way, but a big driveway. They did look into buying a lot, but that would result in non-conforming lots, as they were not meant to be corner lots.

Chairman Forsey questioned what amenities were being provided by the cluster development as a cluster development is designed to preserve or save trees or a natural feature such as an overlook. Mr. Johnston stated they haven’t really gotten to that, but there currently isn’t anything existing there. Mr. Sparks stated it won’t be left as grass but he doesn’t currently know if there will be anything like a walking path there.

Member Conrad questioned if drain off will be a problem for the Old English Road residents and Mr. Johnston stated no, they will take care of the drain off with a swale with drains.

Member Wingard asked how much fill will be needed. Mr. Johnston stated he didn’t yet know.

Member Balcerzak questioned if extensive clearing will need to be done. Mr. Johnston stated no, most of the trees are in the wetland that isn’t being touched and the rest is pretty clear.

Member Thorman asked how much of a problem it would be to have an entrance way on the 50’ wide area. Mr. Johnston stated that it’s not so much a problem, but he feels the residents may be upset and suggested possibly a 12’ walking area

could be put there that would accommodate an emergency vehicle if necessary. Mr. Sparks stated a walking area that would allow access by an emergency vehicle had been proposed on another development and many issues were caused by it.

Member Balcerzak stated this is mixing two ways of life, patios without children and single families with children. Mr. Johnston stated having the NYSEG division makes it seem like separate developments.

Ms. Braun noted a preliminary plat will have to be done also before a decision is made.

Larry Haseley noted he has lived on Old English Road for 34 years and wondered if there will be a connecting road to Old English. Mr. Johnston stated no.

Mr. Johnston stated the alternative to this project is a standard single family development but feels this is a better plan and he will prepare a preliminary plat.

MOTION made by Member Kinyon, seconded by Member Conrad to adjourn. 7
