A regularly scheduled work session of the Lockport Town Board was conducted at 1:00 p.m. on Wednesday, June 18, 2008, at the Town Hall, 6560 Dysinger Road, Lockport, New York.


Present were: Supervisor: Marc R. Smith

Town Council members: Cheryl A. Antkowiak
Paul H. Pettit
Mark C. Crocker

Absent: Paul Siejak

Also present: Nancy A. Brooks, Town Clerk; Daniel E. Seaman, Town Attorney (late arrival at 1:45 p.m.); and Robert Klavoon of Wendel-Duchscherer.

Supervisor Smith opened the meeting for the following discussion and/or action:

1. Town Priorities for 2008

Transit Road Focus Group - Supervisor Smith stated that the Town has met with the City of Lockport, the Town of Pendleton and with representatives of
Wendel-Duscherer and the NYSDOT to develop the group’s applications to present to the GBNRTC which develop long range traffic and highway plans for the WNY area. He stated that the Town of Lockport will have a good presentation to submit and he hopes that the City of Lockport will be prepared to submit a substantial plan before the GBNRTC when they meet in a few weeks.
He stated that the Transit Road Focus Group designated two primary demonstration project areas on which to concentrate their traffic plan efforts: Transit Road at Robinson Road and Main Street in the City of Lockport, in front of the Lockport Plaza. Some of the desired improvements would be to add medians and cross walks to dress up those corners. He’s hoping to obtain some of the available grant funding for those project areas.

Additionally, he is connecting with some of the contacts made at the Retail Shopping Development Convention in Las Vegas. He is also prepared to start direct mail marketing in the near future.

Town Drainage - Councilman Crocker stated that the Highway Dept. is still completing road work and concentrating on the Town-wide brush pickups. Lewis Hagen, the Highway Superintendent, plans to commence with drainage projects sometime in August, when the weather is the driest.
Councilwoman Antkowiak asked if the area near Home Depot is scheduled for remediation work this summer. Mr. Pettit stated yes, it was on the 2008 Drainage Plan.

Infiltration & Inflow – Councilman Pettit stated that demonstrations of possible solutions for water leaks into the sanitary sewer system have been completed.
He stated that of the two demonstrations, only one proved to be a viable solution for repairs to the existing sewer vents in the Town. He suggested that the Town Board has two areas for consideration at this time: a) the development of specification changes for the Town’s Sewer ordinance and b) the creation of a procedure manual for the vents in need of repair. Mr. Klavoon stated that he
has planned a meeting with Supervisor Smith, Councilman Pettit, Ken Banker of the Sewer Dept. and a Wendel engineer for 1:00 p.m. on July 2, 2008, for the
purpose of developing the specification change to the Sewer ordinance.

Additionally, Councilman Pettit reported that the second test, involving equipment to install a “sleeve” over the broken sewer vent pipe, was very successful, and will be a viable and less expensive solution, at only $125.00-$145.00 per repair. He noted that the Town could rent the equipment from the demonstration company as well as have the company complete the work. The Town’s Sewer Dept. personnel would also be capable to completing the work if the Town rented or purchased the necessary equipment. Councilman Pettit and Mr. Klavoon were in agreement, stating that this procedure would also prove to be
a viable solution for water line leaks, in areas that have known problems such as the Northview Gardens area which was video taped for leak detection in the summer of 2007. This procedure is a simple fix which does not disturb the
homeowner’s yard so the Town does not have to face yard restoration costs. It would just be a matter of determining a fair charge to pass on to the resident.

Merger of Sewer and Water Districts – project remains on hold.

Day Road Park Improvements – Councilwoman Antkowiak stated that the Recreation Committee has investigated the purchase of some permanent umbrellas for the tables at the park. She also stated that an exterminator
had been called in to handle a problem of bees in and or around the table and playground areas.

Regarding the irrigation and topsoil & seeding projects for the park, Councilwoman deferred comment to Mr. Klavoon. He stated that the Town had originally planned to bid out the two projects (irrigation & top soil/seeding)
in two separate bids. However, it was learned that it is best if the sprinkler heads are set after the seeding has been completed so the Town will now bid the two projects as one. This will make the companies bidding the irrigation and seeding work, to work together to place a bid. The project specifications have been sent to the Town Attorney for review.

2. Clerk/Communications

The Town Clerk reported communications received were as follows: a letter from NYSEG, copy of resolution by the Lockport City Council, a Notice of Public Hearing by the Town of Pendleton Zoning Board of Appeals,
and a copy of a resolution by the Royalton Town Board.

3. Attorney – No report.

4. Engineer

Donner Creek – Mr. Klavoon reported that the will meet with the NYSDOT in the near future for discussion and review of the Town’s recently filed plan of action.

East High Pump Station – He reported that all the work is completed and that he is waiting for the contractor’s closing documentation.

Pump Station Rehab & Robinson Road Line Telescoping Projects - Both projects are scheduled for bid opening on June 24, 2008.

Leak Detection Quotes – Mr. Klavoon stated he still has emails out to contractors soliciting quotations for a town-wide leak detection program. He will advise the Town Board when he has obtained two additional quotes.

5. Town Board Comments

Councilwoman Antkowiak – She stated that she was recently in the Village Mobil Home Park during a moderate rain and that the flooding was quite serious.
She wondered if this was a Town issue or a private drainage issue. Supervisor Smith stated the park was a private issue and that they would have to address
the issue. Councilwoman Antkowiak will contact the park to make them aware of the situation.

Additionally, she stated there were several street lights outs in her neighborhood and that she reported the problem to NYSEG, who promptly came out to fix the problems. NYSEG requires the pole numbers to arrange for a service calls. She thinks this would be good information to place in the next Town newsletter.

She also asked about the Niagara County 200th Bicentennial Banners that the Town has displayed in the Town Hall parking lot. She wondered how long they will be flown. Supervisor Smith stated they will probably be left up for the remainder of this year. She commented on the banners which the Town of Clarence has on display throughout the Town. Their bicentennial banners
are sponsored by area families and businesses and the names are printed on each banner. She thinks this is something to keep in mind for the future.

6. Supervisor’s Comments

GBNRTC – He requested the Town Board’s signatures on letter s supporting the Town’s application to the GBNRTC for traffic improvements along the Transit Road corridor.

Health Insurance Rates – He reported that the Town has received confirmation that the annual insurance premiums will be reflecting a 5% decrease for 2009.

Baseball Contracts – He presented for approval, the 2008 Recreation agreements with the various organizations that provide summer baseball for Town residents

MOTION: to approve the contracts with Lockport Little League, ANJO Baseball League and the Town of Pendleton, to provide baseball programs for Town of Lockport residents during the summer of 2008, was made by Council member
Antkowiak, seconded by Council member Crocker. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, and Smith.

Recycling Program – Supervisor Smith stated he had met with Ken Horvath to discuss possible improvements to the Town’s current recycling program. Mr. Horvath offered two suggestions: to offer larger recycling bins to residents and to increase the monitoring of the recycling done throughout the Town. He also suggested a possible Town-wide contest to recognize those residents that participate the most. Supervisor Smith stated that providing a larger recycling bin, for which residents would pay a fee, may be a possibility which he will investigate. Additionally, Supervisor Smith will request monthly reports from Waste Management to better ascertain the effectiveness of the Town’s program and perhaps compare that to other surrounding communities. Some Town Board discussion of this issue followed. Councilman Crocker felt there was no need to offer additional incentives to encourage participation. He feels that Town residents already are encouraged to participate and realize the importance and the savings to themselves and to the environment.

Town Hall Lighting – The Town engineer has provided information that would indicate the Town could realize a 5 year payback savings if the Town Hall was converted over to low energy lighting. This will be considered for inclusion in the 2009 Town budget.

Town Hall Security Improvements – Supervisor Smith stated the Town Board does not openly discuss security improvements during open session but will discuss the improvements which would amount to approximately $3800 in Executive Session.

Video Projector Screen - The automated projection screen has been recently installed in the Town Board meeting room. A video projector is still needed and will eventually be mounted on the ceiling. This will allow visual aid presentations to be conducted for the Town Board, Planning Board and Zoning Board. Supervisor Smith stated he is still investigating prices for the projector.

Architectural and Design Code Review – Supervisor Smith asked if the Town Board had any questions regarding the proposed Local Law to establish an Architectural and Design Review Code. There were no questions from the Board members.

Park & Ride – Supervisor Smith stated that in light of the recent increase in gas prices, he had received a request from a resident for the Town to provide a “park and ride” location. He will contact some of the area property owners for prospective sites and will advise the Board of his findings.

7. Executive Session Entered

MOTION: to enter Executive Session for the purpose of discussing contractual matters was made by Council member Crocker, seconded by Council member Pettit. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, and Smith.

The Town Board entered Executive Session at 1:43 p.m.

Executive Session Exited and Work Session Reconvened

MOTION: to exit Executive Session was made by Council member Antkowiak, seconded by Council member Pettit. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, and Smith.

The Town Board exited Executive Session and reconvened the work session at 2:45 p.m. with no action taken.

8. Adjournment

MOTION: to adjourn was made by Council member Antkowiak, seconded by Council member Crocker. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, and Smith.
