Mayor Michael W. Tucker called the meeting to order.

070208.1 APPROVAL OF MINUTES

On motion of Alderman Lombardi, seconded by Alderman Pasceri, the minutes of the Regular Meeting of June 18, 2008 and the Special Meeting of June 25, 2008 are hereby approved as printed in the Journal of Proceedings. Ayes 6. Carried.

FROM THE CITY CLERK

The Clerk submitted payrolls, bills for services and expenses, and reported that the Department Heads submitted reports of labor performed in their departments.

Communications (which have been referred to the appropriate City officials)

6/19/08 Paul W. Westfall, Cornell Cooperative Extension, Niagara County, 4487 Lake Avenue, Lockport, NY – request to erect two banners to promote the 2008 Niagara County Fair. Referred to the Committee of the Whole.

6/27/08 Richard P. Mullaney, City Clerk – notification that the Lockport Municipal Building will be closed on Friday, July 4, 2008 in observance of Independence Day. Garbage scheduled to be collected on Friday, July 4th, will be picked-up on Thursday, July 3rd. Referred to the media.

7/2/08 Norm Allen, Director of Engineering – note urging Mayor and Common Council members to attend a public information meeting to be conducted by the NYS Department of Environmental Conservation on Thursday, July 15, 2008 at 7:00 p.m. at Lockport City Hall concerning contamination of the NYSEG substation on South Transit Street. This meeting will present the results of the Remedial Investigation at this site. Referred to the Committee of the Whole.

Resolved, that the Mayor and City Clerk be authorized to issue orders in favor of the claimants for payrolls, bills, and services to be paid on July 4, 2008.

Resolved, that claims authorized for payment by the Director of Community Development, and subsequently paid from the Community Development Escrow Account, be and the same are hereby approved.

Resolved, that the Mayor and Common Council do hereby extend condolences to the family of John W. Barnwell II, a retired City of Lockport Firefighter who recently passed away.

Resolved, that the Mayor be and the same is hereby authorized and directed to execute an agreement with the Niagara Tourism & Convention Corporation, and be it further
Resolved, that the City Treasurer be and the same is hereby authorized and directed to transfer $23,000 from Account 01 1900.1910 Insurance to 01 8510.434 Community Beautification (Events & Transportation).
Seconded by Alderman Schrader and adopted. Ayes 6.

Whereas, the Common Council by resolution number 121907.10 authorized the Mayor to execute an agreement with Ulrich City Centre, LLC and Canal Concert Series, Inc., for the Canal Concert Series, and

Whereas, as part of said agreement the City of Lockport is responsible for providing the necessary funding for the stage for eight (8) events at a cost of $7,975.00 per event, now therefore be it

Resolved, that the 2008 budget be amended as follows: Create account # 434 (Events & Transportation) in Account # 01 8510 Community Beautification, and be it further

Resolved, that the City Treasurer be and the same is hereby authorized and directed to transfer $64,000 from account 01 1900.1910 to the newly created account # 01 8510.434.

Resolved, that the Table of Organization in the 2008 Budget be amended as follows:
Delete the title of Building Maintenance Worker in account # 03 8130.100, and Create the title of Building Maintenance Worker in account # 01 1620.100. Cost of same to be charged to 01 1620.100.
Seconded by Alderman Pasceri and adopted. Ayes 6.

By Alderman Pasceri:
Resolved, that pursuant to their request, the Cornell Cooperative Extension of Niagara County is hereby granted permission to erect a banner at least 17 feet from the ground across Lake Avenue at Olcott Street beginning July 21 to August 1, 2008 and a second banner on East Avenue at Davison Road beginning July 21 to August 4, 2008 to promote the 2008 Niagara County Fair. Said permission is subject to Cornell Cooperative Extension filing a certificate of insurance with the City Clerk naming the City of Lockport as additional insured, and be it further
Resolved, that the Building Maintenance Department is hereby authorized and directed to erect the banner.

Resolved, that All Saints Church is hereby granted permission to barricade Adam Street between Garden Street and Market Street on August 10, 2008 from 8:00 a.m. to 6:00 p.m. for their Garlic Festival, and be it further
Resolved, that the Highways & Parks Department be and the same is hereby authorized and directed to deliver barricades to said area prior to and pick them up after the event.
Seconded by Alderman McKenzie and adopted. Ayes 6.

Resolved, that the table of organization in the 2008 General Fund Budget be amended as follows:
Account #01 31200.100 Police - "insert" one (1) Police Officer.

AUTHORIZATION FOR COLLATERAL MORTGAGE

WHEREAS, on June 26, 2006 the City of Lockport leased 3 Niagara Street, 49,51,53,57,69, 79 and 81 Canal Street (f/k/a Richmond Avenue) to the Greater Lockport Development Corporation for development, and

WHEREAS, on June 29, 2006, the Greater Lockport Development Corporation (“GLDC”) entered into a sublease agreement, development agreement, loan agreement, and management agreement with Richlock, LLC for development of the aforesaid parcels, and

WHEREAS, the GLDC passed a resolution on June 26, 2008, authorizing the President to sign a certain Purchase and Sale of Leasehold Agreement acquiring the developer’s rights and interests in the aforesaid parcels for the sum of $300,000 and other consideration, and

WHEREAS, the GLDC desires to finance the cash aspect of the acquisition by entering into a promissory note and mortgage for the sum of $200,000 for two years at 4%, and

WHEREAS, since the City of Lockport remains in legal title to the aforesaid parcels a request has been made by the GLDC to have the City of Lockport execute a collateral mortgage pledging the aforesaid parcels as security for the payment of the aforesaid note and mortgage by the GLDC.
NOW THEREFORE, BE IT

RESOLVED, that the Mayor be and is hereby authorized to execute the Purchase and Sale of Leasehold Interests Agreement with Richlock, LLC and the GLDC on behalf of the City of Lockport and a collateral mortgage for 3 Niagara Street, 49,51,53,57,69, 79 and 81 Canal Street (f/k/a Richmond Avenue) for the sum of $200,000 for a term of 2 years at 4% interest.

Seconded by Alderman Kibler and adopted. Ayes 6.

By Alderman Kibler:

WHEREAS, at certain times of the day stacking of cars occurs in the southbound lane at the corner of Lincoln and Locust Street in the City of Lockport, and

WHEREAS, the Niagara County Department of Planning requested that the City join them in a study of the Lincoln corridor to address the increase in traffic along Lincoln Avenue and after holding a ward meeting and after hearing the local residents in opposition to the same the City declined to participate in said study and project, and

WHEREAS, the Traffic Safety Committee met and reviewed the situation and passed a resolution recommending the placement of a "No Left Hand Turn" sign during the hours of 2 p.m. to 7 p.m.

NOW THEREFORE BE IT

RESOLVED, that the Vehicle and Traffic Code, §183.46 SCHEDULE III: Prohibited Turns be amended by inserting the following (in bold):

and be it further

Resolved, that the Highways & Parks Department be and the same is hereby directed to erect the appropriate signage.

At 6:13 P.M. Alderman Lombardi moved the Common Council be adjourned until 6:00 P.M., Wednesday, July 16, 2008.
