A regularly scheduled work session of the Lockport Town Board was conducted at 1:00 p.m. on Wednesday, August 20,2008, at the Town Hall, 6560 Dysinger Road, Lockport, New York.
Present were: Supervisor: Marc R. Smith
Town Council members: Cheryl A. Antkowiak
Mark C. Crocker
Paul Siejak
Absent: Paul Pettit
Also present: Nancy A. Brooks, Town Clerk, Daniel E. Seaman, Town Attorney and Robert Klavoon of Wendel-Duchscherer.
Supervisor Smith opened the meeting for the following discussion and/or action:
1. Town Priorities
Transit Road Focus Group – Supervisor Smith stated that he had met with Mary Whalen, Manager of the Fashion Outlet Mall of Niagara. He said it was a very positive meeting and that she had given him some useful information about
retail businesses that would be beneficial to contact. She explained how she fills up available spots within the mall and Supervisor Smith will meet with Mr. Klavoon to develop a similar plan for the Transit Road area. He also mentioned that he had sent out the marketing packet to movie cinema developers and that he had been contacted by one who gave him a lot of useful information regarding the movie theater industry and how to attract this type the retail business.
Town Drainage – Councilman Crocker stated that the Highway Dept. continues to work on Day Road Park soccer fields and that they will commence with drainage projects as soon as the soccer field work is completed.
Infiltration and Inflow – Supervisor Smith stated that he and Councilman Pettit will soon be meeting with the vendor of the “A Clamp” system. In the meantime,the Town is proceeding with the televising project which Mr. Klavoon will address.
Merger of Sewer & Water Districts – The Town Attorney is still gathering information. This will most likely to a topic for sometime in the Fall.
Day Road Park Improvements – Cheryl Antkowiak informed the Board that a resident suggested that the pathway leading to the portable restroom have painted lines as a safety precaution. The woman had a child run off the path and into the parking lot where cars were nearby.
2. Town Clerk
The clerk stated correspondence had been received from the City of Lockport regarding a resolution passed calling for a Public Hearing on a request for a special use permit to conduct a “Farmer’s Market” and “Arts and Crafts” on
the property located at 767 -801 Market Street, Lockport, NY
Additionally, she stated that liquor license renewal notifications had been received from Manhattan’s Restaurant at 4206 Lake Ave and for Alexander’s Restaurant located at 5925 S. Transit Rd., Lockport, NY. The Town Board did not voice any concerns or objections to the license renewals.

3. Attorney
Mr. Seaman presented the Town Board with a proposed Local Law – An Amendment to Chapter 53 of the Town Code, amending Chapter 53-8 Sections J-L and Chapter 53-10 Section D. He asked that the Town Board members review the proposed law and determine if the law will be introduced and a Public Hearing called for.
4. Engineer
Pump Station Rehab Project – Mr. Klavoon stated that a Notice to Proceed had been sent to Tunney Electric and that he expected to meet with them in the next few weeks on a pre-construction meeting. Work on the Strauss
Road lift station should commence shortly after.
Robinson Road Lift Station Televising – Mr. Klavoon stated a Notice to Proceed had also been issued for this project and that he expected that a substantial amount of the work will be completed within six weeks and that the entire project should be completed within eight weeks.
Water Leak Detection – Mr. Klavoon stated that the specifications and vendor quotation information for this project were recently sent to the Town Attorney for review and for contract documents to be drawn up.
5. Town Board Comments
Councilwoman Antkowiak - She stated that the Town Recreation Committee recently mailed a survey out to residents whose children have participated in the swim lesson program to get some input on the program which has been done for several years.
Councilman Siejak asked if there had been any feedback on setting a date for a joint educational meeting of the Town Planning and Zoning Boards. Supervisor Smith stated that he is still waiting for available dates from Andrew Reilly, the Town’s planner.
6. Supervisor’s Comments
Day Road Park – Supervisor Smith stated he had spoken with Paul Pettit with regard to the new soccer fields and that Councilman Pettit feels that a professional should be hired to hydroseed the fields this September. The
estimated cost for utilizing a professional would be near $13,500. To hire an outside contractor would require approximately $10,000 additional funds to be allocated for this purpose. Supervisor Smith stated he is also investigating the possibility of renting a hydroseed machine from the Niagara County Soil and Water Conservation Dept. This would require Town personnel to learn how to operate the equipment to help keep costs down. Additionally, seeking a professional would require specifications to be drawn up, RFPs to be obtained, all of which would be a time concern and additional expenses for completing the fields this year. Mr. Klavoon stated that Fall would be the optimal seeding time for the fields which would be available for use come Spring. Supervisor Smith stated the fields are ready for seeding now but he would like a couple more days to investigate the matter.
Town Health Insurance Plan – Supervisor Smith stated that the Town’s retirees had met concerning the new Medicare Support Plan and that the meeting went well.

Park and Ride – Supervisor Smith is still working on this and will report at a later date.
Sewer Rate Study – Rob Klavoon is still working on this and will report at a later date. The last time a study was done was in the 1990’s.
Ruhlmann Road Cleanup – Nature’s Way should have the cleanup complete by the end of August.
Executive Session Entered
MOTION: to entered Executive Session for the purpose of consulting with the Town Attorney and to discuss the work history of an employee was made by Council member Siejak, seconded by Council member Crocker. The motion
was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Crocker, Siejak and Smith.
The Town Board entered Executive Session at 1:22 p.m..
Executive Session Ended and the Work Session Reconvened
MOTION: to exit Executive Session and to reconvene the work session was made by Council member Antkowiak, seconded by Council member Crocker. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak,
Crocker, Siejak and Smith.
The Executive Session ended at 1:57 p.m. with no Town Board action taken.
Adjournment
MOTION: to adjourn was made by Council member Antkowiak, seconded by Council member Siejak. The motion was CARRIED: AYES-4, NAYS-0. Voting AYE: Antkowiak, Crocker, Siejak and Smith.
The meeting ended at 157 p.m.
The Lockport Town Board will next meet at 1:00 p.m. on Monday, Sept.8, 2008.
