A regularly scheduled work session of the Lockport Town Board was conducted at 1:00 p.m. on Monday, September 8, 2008, at the Town Hall, 6560 Dysinger Road, Lockport, New York.

Present were: Supervisor: Marc R. Smith

Town Council members: Cheryl A. Antkowiak
Paul H. Pettit
Mark C. Crocker
Paul Siejak

Also present: Nancy A. Brooks, Town Clerk, Daniel E. Seaman, Town Attorney and Robert Klavoon of Wendel-Duchscherer.

Supervisor Smith opened the meeting to the following discussion and/or action:

1. Town Priorities

Transit Road Focus Group – Supervisor Smith has talked with several developers over the past few weeks. They continue to show interest but no one has taken any serious steps.

2009 Budget Work Sessions – The 2009 budget will be discussed at the next regularly scheduled work session on September 17, 2008. The next one will be scheduled for 1:00 p.m. on September 23rd or 24th. Supervisor Smith will check with Bob Lipp,Budget Officer, and will inform the Board of the exact date as soon as possible. The Clerk will need to publish the date when it is decided. Additionally, the Town Board will receive their budget packets to review within the next few days.

Town Drainage – Councilman Crocker reported that the Highway crews will soon start work on the Collins Dr. /Royal Parkway So. /Wills Hollow area in the next few days. Late in September and early October they will conduct the last brush pickup for 2008. Following that, they will start other approved 2008 drainage projects.

Infiltration & Inflow – Councilman Pettit stated that the Town’s basic plan is in the works, being that the town-wide water leak detection study will soon begin and the Water Dept. is currently installing the recently purchased drainage basins at troublesome locations. He stated currently, that the most needed step is to develop the new specifications for the Town’s sewer ordinance. He will meet with Rob Klavoon in the near future to determine the new requirements to amend the ordinance.

Supervisor Smith also commented that in addition to cutting the water losses, he has asked the Niagara County Sewer District how the Town’s sewer rate is derived.
He knows that the amount of water used is an integral part of the formula used to determine the sewer rate but he is interested in seeing how the Town’s new implementations and steps such as the water leak study can reduce the Town’s water use and how that will be reflected in the Town sewer rate.

Merger of Sewer and Water Districts – The Town Attorney is currently working on this project.

Day Road Park – The Park’s soccer fields are now completed. The Town’s Highway & Water Department personnel completed the grading, seeding and fertilizing of the fields at a savings of nearly $100,000 over the estimates from outsourcing the project. Councilman Pettit strongly urged that the Town determine who will be responsible for the maintenance and scheduling of the soccer fields for the spring of 2009. He urged the

Board to investigate the possibilities of using an outside organization to control the fields to prevent scheduling and use conflicts in the future. Supervisor Smith stated that the Town Recreation Committee should be the group to oversee the issue. Councilwoman Antkowiak stated the Recreation Committee has already been in contact with
Mr. Jim Slowey of the Lockport Soccer Association. She stated he will be asked to address one of the upcoming Recreation Committee meetings. Councilwoman Antkowiak stated she will report to the Board after hearing Mr. Slowey’s expertise on the subject. Additionally, Councilwoman Antkowiak will meet with Mr. Seaman to
discuss the legalities and possible contract issues.

2. Town Clerk/Communications

The Clerk reported that correspondence was received on the following topics:

Tonawanda Creek Road at Minnick Rd Street Repair – U.S. Corps. of Army Engineers has stated that the repair work will restart and is expected to be completed by the end of
November 2008.

Petition for Speed Study - a petition of 22 signatures was received requesting a speed reduction on Day Road between East High Street and North Canal Road. Additionally, the petition asked for a widening of the road shoulder for the same mentioned strip of highway due to increased number of accidents and increased number of bicycles,
and pedestrians accessing the Day Road Park.

MOTION: to forward to the NYSDOT, a speed study request for Day Road between East High Street and North Canal Road, if not completed within the last two years, was made by Council member Pettit, seconded by Council member Siejak. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.

Town and Country Club Liquor License Renewal – notice of their intent to renew their current liquor license was received. The Town Board voiced no concerns about such renewal.

2008 Primary Election –The Clerk just reminded the Town Board of the Primary Election hours on Tuesday, September 9th and that the Niagara County Board of Elections has now consolidated the Town polling sights to five fire hall locations throughout the Town. This will no doubt cause much confusion for voters.

3. Attorney

Mr. Seaman just reminded the Board of the proposed Local Law to amend the Architectural & Design Review Code which he presented at the previous Town Board meeting. This proposed Local Law will be placed on the agenda for the Sept.10, 2008 Town Board meeting.

4. Engineer

Mr. Klavoon reported on the following:

Water Leak Detection Study – he has been in contact with the contractor and the work is scheduled to begin the week of September 13th. The study will be conducted during pre-dawn hours in case Board members or officials get calls on the matter. The Sheriff’s office will be notified.

Sewer Rehab Phase 4 – Mr. Klavoon conducted a pre-construction meeting with the contractor. The generators and materials have been ordered. The Robinson Road
lift station will be a pre-cast concrete building located in front of one of the apartment complexes. The station will be placed on a Town-owned parcel (20’x50”) and was chosen to prevent vandalism. Construction should take 4-6 weeks.

Robinson Road Televising and Flushing – He met with New England Pipe Cleaning Co. and the project is expected to begin soon and should take 2-3 weeks to be completed.
A report will be completed at the conclusion of the study.

Town Sewer Rate Analysis – He has asked the Town Water Dept. for some information and should have a report completed very shortly.

5. Town Board Comments

Councilwoman Antkowiak spoke on several issues including:

Lockport Library Program – she stated that the Library will conduct a family “Story Night” program, geared toward children, at the Town Hall on Wednesday evenings
during October. The program is scheduled to take place 6:00 – 7:15 p.m. which may conflict with the Town Board’s regular monthly business meeting for October.

MOTION: to change the starting time of the regular Town Board business meeting on October 8, 2008 from 7:30 p.m. to 7:45 p.m. as not to conflict with the Lockport Public Library Story Program to be held at the Town Hall that same day, was made by Council member Antkowiak, seconded by Supervisor Smith. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.

The Town Clerk will publish notice of the change.

Movie Night Sponsorship – Councilwoman will meet with Mr. Seaman to discuss the possibility of a Town sponsored movie night at the Palace Theatre.

Budget Encumbrances – She asked how the Recreation Committee can encumber funds from 2008 to the 2009 budget for the purpose of enhancing the “Community Day” celebration. Supervisor Smith noted that encumbered funds must be ear-marked for specific items or services ordered in 2008 but not obtained and paid for until 2009.
He did not feel there was a need to encumber funds for the desired project – the cost should just be figured into their 2009 budget estimates.

Winter Wellness Program – The Dale Association will provide an evening fitness program (hearing and sight program). No specifics have been worked out yet.
Fall Newsletter – She announced that there was a problem with the scheduling of the fall newsletter. She stated that several of the fall Recreation programs are normally published in the Fall newsletter but this year she was told the letter would be going out quite late in October, which would prevent several programs from being publicized. Supervisor Smith stated that as this involves one particular employee, the issue should be discussed in
Executive Session.

Grant Writing Seminar for Recreation – Councilwoman Antkowiak stated she will be attending a seminar specific to grant writing for recreational projects. Her attendance will be sponsored by someone outside of the Town so there will be no cost associated.

Councilman Siejak – He stated he received an email regarding the joint meeting of the Planning Board and the Zoning Board for training on the recently adopted Architectural and Design Review Code. The meeting is scheduled for 4:30 p.m. on Wed. October 8, 2008. The meeting will meet at the Town Court facility as not to disrupt the program being given by the Lockport Public Library.

6. Supervisor’s Comments

Health Insurance – He reported that enrollment of retirees into the Medicare Supplement program is going smoothly.

7. Executive Session

MOTION: to enter Executive Session for the purpose of consulting with the Town Attorney and to discuss the work history of an employee was made by Council member Pettit, seconded by Council member Antkowiak. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.

The Town Board entered Executive Session at 1:58 p.m.

8. Executive Session ended and Work Session Reconvened

MOTION: to exit Executive session and to reconvene the work session was made by Council member Antkowiak, seconded by Council member Crocker. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.

The Town Board exited Executive Session at 2:58p.m. with no action taken.

9. Adjournment

MOTION: to adjourn was offered by Council member Siejak, seconded by Councilman Crocker. The meeting was ended at 2:58p.m. The Lockport Town Board will next meet at 7:30 p.m. on Wednesday, September 10, 2008.
