A regularly scheduled work session of the Lockport Town Board was conducted at 1:00 p.m. on Wednesday, September 17, 2008, at the Town Hall, 6560 Dysinger Road, Lockport, New York.
Present were: Supervisor: Marc R. Smith
Town Council members: Cheryl A. Antkowiak
Paul H. Pettit
Mark C. Crocker
Paul Siejak
Also present: Nancy A. Brooks, Town Clerk, Daniel E. Seaman, Town Attorney and Robert Lipp, Town Budget Officer.
Supervisor Smith opened the meeting for the following discussion and/or action:
1. Town Priorities
The Town Priorities were dispensed with to abbreviate the agenda to work on the 2009 Tentative Town budget.
2. Clerk/Communications
The Town Clerk reported that Spring Lake Winery on Rochester Road has sent notice of their intent to renew their liquor license.
3. Attorney – nothing to report.
4. Engineer – Mr. Klavoon was not present to report.
5. Town Board Comments
Councilman Siejak – reported that the date of the joint Planning and Zoning Board meeting to review the recently adopted Architectural & Design Review Code has been
changed to October 15, 2008 at 4:30 p.m., directly following the Planning Board work session.
Additionally, he informed the Board that the town-wide water leak detection study will begin on Sept. 21, 2008. The contractor’s crew will be conducting the study on bicycles late at night and during pre-dawn hours. They will cover 5-6 miles per day and the study should be completed within 4-6 weeks.
6. Supervisor’s Comments
GAR Associates – Supervisor Smith stated that he had received the proposed 2009 contract for town-wide assessment program which keeps the Town of Lockport’s assessments at 100% of evaluation rate. He stated the contract calls for the same amount as 2008.
MOTION: to authorize the Supervisor to enter an annual contract with GAR Associates for 2009 Town Assessment program, in the amount of $15,000.00, was made by Council member Crocker, seconded by Council member Pettit. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.

B.A.R. Appointment – Supervisor Smith stated that the Board of Assessment Review is short one member due to the resignation of Donald Roeseler and the position must be filled. The Town Assessor has forwarded the name of Joanne Hayes, retired Town of Lockport Assessment Information Clerk, to be considered for the position.
MOTION: to appoint JoAnne Hayes as a member of the Town of Lockport Board of Assessment Review, the term to expire 09/30/2013, was made by Council member Pettit, seconded by Council member Antkowiak. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.
Dale Association “Team Work” Award – Supervisor Smith congratulated Councilwoman Antkowiak for being selected as the recipient of this award. There will be an award ceremony on September 25, 2008.
7. Budget Review
Mr. Lipp led the Town Board in a line-by-line review of the 2009 Tentative Town Budget as prepared by himself and Supervisor Smith.
8. Executive Session Entered
MOTION: to enter Executive Session to discuss personnel issues that will affect the 2009 Town Budget was made by Council member Crocker, seconded by Council member Pettit. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.
The Town Board entered Executive Session at 2:25 p.m.
9. Adjournment
MOTION: to exit Executive Session and to adjourn was made by Council member Pettit, seconded by Council member Antkowiak. The motion was CARRIED: AYES-5, NAYS-0. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.
The Town Board exited the Executive Session and adjourned the work session at 3:06 p.m. with no Town Board action taken during Executive Session. They will next meet at 1:00 p.m. on Tuesday, September 23, 2008 for another 2009 Town Budget work session.
