The Planning Board Meeting was called to order at 7 30pm by Chairman Forsey who then led the Pledge ofAllegiance
Alternate Member Balcerzak stated there is a correction for the March 20th minutes onpage 7 last paragraph 6th line from the bottom third word in should be changed from left to right MOTION made by Member Langdon seconded by Member Few to accept the corrected March 20 2007 minutes 7 Ayes 0 Nays Carried

Pozantides stated yes Mr Pozantides stated they will be changing the landscaping moving it more to the left to put the patio where the current landscaping is

MOTION made by Member Langdon seconded by Member Conrad to determine this is aType n action under SEQRA waive the Public Hearing and approve the outdoor patio for Alexander s at 5925 South Transit Road as presented 7 Ayes 0

Attorney Seaman asked if there are any engineering questions and Town Engineer Klavoon stated no
hairman Forsey asked if the Board was satisfied with the landscaping No Issues. Member Conrad questioned the signage with the bright colors that he didn tfeel
is consistent with the rest of the Transit Corridor Member Conrad stated WalMart McDonald s and NAPA all made their colors softer as requested by the Board Chairman Forsey stated he liked the darker red shown on the design rather
than abright red Mr Wilhelm stated he isn tsure what the manufacturer s colors are Chairman Forsey suggested something in a duller shade ofred like a brick color

MOTION made by Member Wingard seconded by Member Langdon to
determine this is a Type II action under SEQRA at 6145 South Transit Road Gambino Ford Resale Center waive the Public Hearing and approve the site plan marked as Exhibit A as presented 7 Ayes 0 Nays Carried

CASE 3 Tonawanda Creek Road SBL 167 01 1 84 Louis Polito Owner Pine Housing ofW NY Preliminary Plat Review Proposed 50 unit senior housing 63 Acres R2 zoning Attorney Seaman asked if their variances had been approved by the Zoning Board ofAppeals and the presenters stated yes Town
Engineer Klavoon stated they have issued areview memo and had received the revised plans today and only have two small items to address Town Planner Klavoon stated the north south drainage ditches will belong to the owners but the Town will need an easement and the Town also needs to be provided with a contour map Town Engineer Klavoon stated the pond will take the water off the site and discharge it to Mud Creek Chairman Forsey asked ifthere are any plans for the area to the north and the
presenters stated no Chairman Forsey asked if they plan to mow it The presenters stated anything that is undisturbed will be left undisturbed but they will be mowing back as far as the ponds acouple oftimes a year as needed Member Thorman asked where the topsoil will be moved to The presenters pointed out an area on the site plan Member Wingard questioned ifthe project is in the Commercial Corridor Overlay District and they are not Ground breaking is planned for next year Member Conrad asked if the vans will be there every day to take the clients shopping and the presenter stated that shopping and trips are scheduled not every day Member Conrad questioned if there are enough parking spaces and the
presenters stated there are more at this site than at any oftheir other sites Town Engineer Klavoon stated SEQRA is completed with the Town as the lead agency and part II shows anegative impact

MOTION made by Member Conrad seconded by Member Langdon to determine that the Town Planning Board is the lead agency under SEQRA to determine the project is an unlisted action and to determine that the action will not have a
significant adverse impact on the environment and to direct that a negative determination be prepared 7 Ayes 0 Nays Carried

MOTION made by Member Langdon seconded by MemberKinyon to waive the Public Hearing and accept the site plan dated 4 16 07 for Pine Housing on Tonawanda Creek Road conditioned on receipt ofthe drainage easement for recording as approved by the Town Attorney and Town Engineer and providing a contour map to the satisfaction ofthe Town Engineer 7 Ayes 0 Nays Carried

CASE 4 MOTION made by Member Few seconded by Member Langdon to hold a Public Hearing for McDonald s at 5859 5863 South Transit Road and 6210 6216 Hamm Road May 15 2007 at 7 30 pm 7 Ayes 0 Nays Carried

CASE 5 Beattie Avenue LLC 123 00 1 8 11 UlrichSparks Subdivision Development Tim Arlington ofApex Engineering presenting Chairman Forsey reminded everyone the Public Hearing has remained open from the March 20 2007 meeting Chairman Forsey asked for Public Comment Hearing none
Chairman Forsey closed the Public Hearing Chairman Forsey asked Mr Arlington if the baseball diamond could be moved more east Mr Arlington stated he will discuss it with his clients Mr Arlington stated they have been in touch with Town Planner Reilly regarding some ofthe SEQRA issues such as drainage and traffic Member Conrad asked if the developer is planning on the Town putting in the
infrastructure for the development Mr Arlington stated no
Members ofthe Board felt the stub road on Eastwood Drive needed tobe kept in the plans for the safety of the residents and to provide cross access between the
developments as well as access to the south in the future Attorney Seaman questioned how large ofan area is involved to the south and how much of it is wetland Ms Braun stated they have aerial views that will show the area best
Member Conrad asked if Wendel Engineering would be giving recommendations for a negative or positive declaration Attorney Seaman stated if certain criteria is met you need to go to part ill and part ill provides the information you need to make a decision based on information sources and what the applicant has provided Town Engineer Klavoon stated traffic is a concern based on Public
input and the traffic review and what they know Ms Braun handed out Part 2 Project Impacts and their Magnitude to the Board members and the Board reviewed the EAF in detail
It was the consensus ofthe Board that Item 1 impact on land will need tobe addressed in a part III as well as Item 3,4,5 and 6 addressing the impact on water water pressure and drainage

Items 12 and 13 impact on Historic and Archaeological resources and open space and recreation only have small impacts Items 15 16 17 and 19 impact on Transportation Energy Noise and Odor and Growth and Character of community all need to be addressed in Ills
Item 20 regarding public controversy related to potential adverse environmental impacts will also need to be addressed in part III
Attorney Seaman asked if we are still waiting in connection with review for the DEC and Town Engineer Klavoon stated no, we have all the reports It was determined to review Part III ofthe EAF and the next meeting prior to making a determination regarding apositive or negative declaration pursuant to SEQURA
