On motion of Alderman Lombardi, seconded by Alderman Kibler, the minutes of the Annual Meeting of January 4, 2008 are hereby approved as printed in the Journal of Proceedings. Ayes 6. Carried.
PUBLIC HEARING
The Mayor announced a public hearing to solicit comments regarding the relocation of Professional Turf Services Inc. located at 519 Mill Street, Lockport, NY to an Industrial Park in Genesee County into the Genesee County Empire Zone.
The Mayor asked the City Clerk if any petitions or communications relative to said relocation have been received.
Recess for public input.
The Mayor closed the public hearing.

1/7/08 Clayton C. Dimmick, 27 Outwater Drive, Lockport, NY – appointed as Building Inspector for the City of Lockport effective January 11, 2008. Said appointment is provisional and subject to New York State Civil Service Rules and Regulations. Received and filed.

Resolved, that claims authorized for payment by the Director of Community Development, and subsequently paid from the Community Development Escrow Account, be and the same are hereby approved.

Resolved, that pursuant to their communication, the National Multiple Sclerosis Society is hereby granted permission to conduct their annual MS Walk in the City on Sunday, May 18, 2008 subject to approval of the walk route by the Police Chief and the Multiple Sclerosis Society filing a certificate of insurance with the City Clerk naming the City of Lockport as additional insured.

Resolved, that a public hearing be held at the Common Council meeting of Wednesday, February 6, 2008 starting at 7:00 P.M. in the Common Council Chambers, Lockport Municipal Building, One Locks Plaza, Lockport, NY relative to a request for a special use permit made by Nigel Martin of High Tread International to operate a steel processing area at 490 Ohio Street, Lockport, NY, and be it further
Resolved, that the City Clerk is hereby authorized and directed to advertise notice of said public hearing.

Whereas, the City of Lockport desires to investigate the feasibility of restoring digestive operations at the Waste Water Treatment Plant, and
Whereas, NYSERDA’s PON 1146 offers to assist local governments with funding for generation of electricity by utilization of methane gas from WWTP operations, now, therefore, be it
Resolved, that the Director of Engineering, subject to Corporation Council approval, is hereby authorized to enter into a contract with Sterns & Wheler for submitting the application for the benefit of the City of Lockport at no cost to the City.

Resolved, that the Common Council hereby finds, in accordance with § 159 of the City Charter, that the best interest of the public will be served by the abandonment of a portion of the property known as Adam Street from Garden Street to Fayette Street, a dedicated street in the City of Lockport, a true copy of the legal description and map of such premises attached to the original of this resolution and also on file in the office of the City Clerk, and be it further
Resolved, that the Mayor of the City of Lockport is authorized and directed, subject to approval of the Corporation Counsel, to execute and deliver a quit claim deed to Christina DiClemente-Neal for the sum of $1.00 and recording costs subject to a utility (telephone, electric, gas and cable) easement of record and any and all other documents necessary and reasonable to accomplish this abandonment and transfer and upon the condition that the spring on said property is kept covered and unused, and be it further
Resolved, that such transfer and abandonment be in the best interests of the City of Lockport and, accordingly hereby dispenses with public bidding in connection with this abandonment.

EXTENDED MILITARY LEAVE POLICY FOR RESERVISTS
Whereas, after the tragic events of September 11, 2001, the City of Lockport recognizes that members of the National Guard and Reserve Forces called into active duty may not receive the same pay they received under State Military Law as they received while working for the City of Lockport, and
Whereas, in appreciation for such dedicated service for our Country, the City of Lockport desires to provide the reservists supplemental pay while City Employees are on leave performing such ordered military duty to make them whole.
NOW, THEREFORE, BE IT
RESOLVED, that such employee who has exhausted his or her entitlement under the Military Law of the State shall then be entitled to supplemental pay and medical insurance while on leave and performing ordered military duty as set forth in more detail in a Memorandum of Understanding between the City of Lockport and the various bargaining representatives/units.
Seconded by Alderman McKenzie and adopted. Ayes 6.

Resolved, that the Mayor, subject to Corporation Counsel approval, is hereby authorized to execute the 2008 agreement between the City of Lockport and Niagara Community Action Program, Inc. at a cost not to exceed $2,500.00. Cost of same to be charged to account #01 8510.429.
Seconded by Alderman Pasceri and adopted. Ayes 6.
