A regular monthly meeting of the Lockport Town Board was conducted at 7:30 p.m. on Wednesday, August 6,2008, at the Town Hall, 6560 Dysinger Road, Lockport, New York.

Present were:

Supervisor: Marc R. Smith

Town Council members: Cheryl A. Antkowiak
Paul H. Pettit
Mark C. Crocker
Paul W. Siejak

Also present: Nancy A. Brooks, Town Clerk, Daniel E. Seaman, Town Attorney.

Following the Pledge of Allegiance, Supervisor Smith opened the meeting for the following business.

PUBLIC COMMENTS: None.

BUSINESS MEETING:

1. Approval of Minutes

MOTION: to approve the minutes of 07/01/2008,07/16/208, and 07/24/2008 was made by Council member Pettit, seconded by Council member Crocker. The motion was CARRIED: AYES-5, NAYS-O. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.


2. Approval of payment of bills,

MOTION: to approve the payment of bills for the month of August was made by Council member Antkowiak, seconded by Council member Siejak. The motion was CARRIED: AYES-5, NAYS-O. Voting AYE: Antkowiak, Pettit, Crocker,Siejak and Smith.

The bills for the month of August include Vouchers #17085 - 17298 in the amount of $517,302.44.


3. Clerk/Communications - None.


4. BuildinQ Inspector's Report

The Supervisor read the report as submitted that stated 80 building permits were issued in July 2008; $17,131.34 was collected in fees; and the estimated cost of construction was $1,482,323.00.


5. Supervisor's Monthlv Financial Report

MOTION: to approve the Supervisor's Monthly Financial Report for the month of July 2008 was made by Council member Siejak, seconded by Council member Antkowiak. The motion was CARRIED: AYES-5, NAYS-O. Voting AYE:
Antkowiak, Pettit, Crocker, Siejak and Smith.

6. Resolution to accept the 2007 Town Audit & Town Court Audit Reports

MOTION: to accept the Town Audit and the Town Court Audit performed by Lumsden & McCormick, LLP for the year ending December 31, 2007, was made by Council member Pettit, seconded by Council member Crocker. The motion was CARRIED: AYES-5, NAYS-O. Voting AYE: Antkowiak, Pettit, Crocker, Siejak and Smith.


7. Town Board Comments

Councilwoman Antkowiak thanked the residents for their participation during the Town Movie Nights and in particular, the Town Community Day. She stated that
all three were well attended and that the Recreation Committee appreciated the participation of the Town of Lockport Historical Society and Historian, Laurence
Haseley; the Dale Association; the Niagara County Sheriff's Dept. for providing the" Kids Identification" program; the volunteer Fire Companies, especially
Rapids Volunteer Fire Company for the additional help they provided; and of course, the music which was provided by the Lockport Federation of Musicians.

She thanked the Recreation Committee for all their hard work and stated that she knows they will continue to improve on the programs offered to Town residents and asked for any suggestions to be passed on the Judi Newbold
in the Town Clerk's office.

She also announced that a new water fountain has been installed at the Day Road Park.


Councilman Siejak thanked Lewis Hagen Jr., Town Highway Superintendent, on the excellent work performed by his department in the replacement of part of Gothic Ledge Road.

Councilman Pettit also thanked the Highway Dept. for their hard work and commented that the design and construction of the Gothic Ledge Road project was an excellent job by Lew Hagen.

He also commented that the Town had recently received sealed bids for the creation of two soccer fields and the installation of an irrigation system at the Day Road Park and that the bids were all rejected due to the amounts being far too excessive than anticipated. He stated that after discussions with Lew Hagen, it was decided that the Town Highway personnel will complete much of the work
to create the two soccer fields, soil and seed will be purchased and the Highway crews will grade and seed the fields before bad weather sets in; all at a substantial savings to the Town.

Additionally, Councilman Pettit reminded residents that all of the volunteer fire departments serving the Town of Lockport, are in need of new members. There are various classifications of service so that almost any resident can offer some kind of assistance to the volunteer fire service.

He also commended the Town Highway and Town Water Departments on their cooperative and collaborative work on the Day Road Park.

Councilman Crocker had nothing to report.


8. Supervisor's Comments

Supervisor Smith urged everyone in attendance to stop by the front foyer to view the Pomeroy Post office desk which is on display from the Niagara County Historical Society. It is the oldest known historical artifact of the Town of

Lockport and will only remain on display for a short time.

Supervisor Smith also reported that he continues to send out information packets on the Transit North Development project. He has sent several packets to area retail developers as well as to area government officials to help make them aware of the need for funding for marketing and development of the Transit Road area.

He also addressed the 2009 Town Budget Schedule stating that he and the Town Budget officer will soon meet to discuss preliminary budget topics in preparation for the Town Board budget sessions which will be held in the near
future.

9. Adjournment

MOTION: to adjourn was made by Council member Pettit, seconded by Council member Antkowiak. The motion was CARRIED: 5, ayes, and the meeting was ended at 7:41 p.m. The Lockport Town Board will next meet at 1 :00 p.m. on
Wednesday, August 20, 2008.
